El AI Act no exige etiquetar cualquier contenido creado con inteligencia artificial, sino únicamente aquel que pueda hacerse pasar por real sin serlo. A partir del 2 de agosto de 2026, será obligatorio avisar cuando una imagen o vídeo muestre personas, escenas o lugares generados o alterados con IA que parezcan auténticos. Un fondo abstracto o un producto sobre fondo blanco no requiere aviso; una modelo virtual o una cara retocada digitalmente, sí. La norma afecta especialmente a tres contextos: ecommerce (modelos virtuales o cuerpos/rostros alterados con IA), redes sociales (activar la etiqueta nativa de contenido IA en plataformas como Instagram o TikTok) y banners publicitarios (cuando aparecen personas generadas por IA con apariencia realista). El aviso debe ser visible, nunca en letra pequeña. El reto principal para los equipos de marketing no es el etiquetado en sí, sino identificar qué parte del volumen de contenido que publican necesita esa etiqueta.
